Terms and Conditions

Welcome to Auto Elektra Veghel. These Terms and Conditions apply to orders and purchases made through our online store and, where agreed, to other contracts entered into with Auto Elektra Veghel.

By placing an order, you enter into an agreement governed by these Terms and Conditions. We recommend reading them carefully before completing your purchase.

Article 2 – Applicability

1. These Terms and Conditions apply to all offers, orders, and agreements between Auto Elektra Veghel and its customers, provided they have been validly incorporated into the agreement.

2. These conditions apply to both private consumers and business customers unless explicitly stated otherwise.

3. Any deviations from these conditions must be agreed upon in writing.

4. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain effective.

5. Mandatory consumer protection rights remain fully applicable and cannot be restricted by these conditions.

Article 3 – Products and Offers

1. Auto Elektra Veghel supplies a range of automotive electrical products, including starter motors, alternators, air conditioning compressors, vehicle security systems, and related components.

2. We make every effort to ensure that product descriptions, specifications, images, and prices are accurate.

3. Product images may differ slightly from the actual product, provided the delivered product meets the agreed specifications.

4. Offers are valid for the stated period or while stocks last.

5. Obvious errors or inaccuracies in product information or pricing shall not be binding to the extent permitted by law.

Article 4 – Orders and Agreements

1. Orders are concluded in accordance with the checkout process on our website and the subsequent confirmation.

2. After placing an order, customers receive an order confirmation by email.

3. Auto Elektra Veghel may refuse an order or request additional information where there is a legitimate reason, such as suspected fraud.

4. If an ordered product is unavailable, we will inform the customer as soon as possible and discuss an appropriate solution.

5. Changes to an order depend on its processing status and must be arranged with our customer service team.

Article 5 – Prices and Payments

1. Prices on our website are displayed including or excluding VAT, depending on the customer environment. Applicable VAT and the total order cost will be clearly displayed before checkout.

2. Any applicable shipping costs will be shown before payment.

3. Payments can be made using the payment methods available during checkout.

4. Orders are processed in accordance with the agreed payment conditions.

5. For business customers purchasing on account, the payment term stated on the invoice or separately agreed in writing applies.

6. In the event of late payment, Auto Elektra Veghel may charge statutory interest and legally permitted collection costs, subject to applicable notice requirements.

Article 6 – Shipping and Delivery

1. Auto Elektra Veghel aims to process and dispatch orders as quickly and carefully as possible.

2. Estimated delivery times will be displayed where available on the product page or during checkout.

3. Unless a different delivery period has been agreed, consumer orders will be delivered within 30 days.

4. In the event of a delay, we will inform the customer as soon as reasonably possible.

5. Products are delivered to the shipping address provided or made available through an agreed collection method.

6. For consumer purchases, the risk of loss or damage generally passes to the consumer upon receipt of the goods by the consumer or a designated third party, in accordance with applicable law.

7. Different delivery and risk arrangements may apply to business customers where agreed in advance.

Article 7 – Right of Withdrawal for Consumers

1. Consumers purchasing products online generally have the right to withdraw from the agreement within 14 days after receiving the goods, without providing a reason.

2. To exercise this right, consumers may send a clear withdrawal statement to info@aeveghel.nl within the withdrawal period or use the withdrawal function available on our website.

3. Following withdrawal, products must be returned to the specified return address within 14 days.

4. Consumers are responsible for direct return shipping costs if properly informed in advance. For defective or incorrectly supplied products, applicable statutory remedies remain in effect.

5. Consumers may inspect products in the same manner as they would in a physical store. Handling beyond what is necessary may result in liability for diminished value.

6. In the event of full withdrawal, Auto Elektra Veghel will refund the purchase amount and original standard delivery charges within 14 days of receiving the withdrawal notice. We may withhold reimbursement until the goods have been returned or proof of return has been provided.

7. Refunds will be made using the original payment method unless otherwise agreed.

8. Statutory exceptions to the right of withdrawal apply only where the relevant legal requirements are met.

Article 8 – Returns and Exchanges

1. Return requests can be submitted by contacting info@aeveghel.nl.

2. Customers are encouraged to include the order number, product details, and reason for return. Consumers exercising their statutory right of withdrawal are not required to provide a reason.

3. Products should be packaged securely to prevent damage during transportation.

4. Business customers do not automatically have a statutory right of withdrawal. Business returns are handled according to separately agreed return arrangements.

5. Returns involving defective products or incorrect deliveries are assessed in accordance with applicable statutory rights and warranty conditions.

Article 9 – Warranty and Product Conformity

1. Auto Elektra Veghel aims to supply products that meet the agreement and reasonably expected quality standards.

2. Consumers are entitled to statutory warranty protection. Its duration depends on the product, reasonable expectations, and relevant circumstances.

3. If a product does not conform to the agreement, consumers are entitled to appropriate statutory remedies, including free repair or replacement and, in certain circumstances, a price reduction or refund.

4. Any manufacturer warranties or additional commercial guarantees do not affect statutory consumer rights.

5. Damage demonstrably caused by improper use, incorrect installation, or external influences is not automatically covered by warranty.

6. Separate warranty arrangements may apply to business customers in accordance with the applicable agreement.

Article 10 – Product Compatibility and Installation

1. Many of our products are vehicle-specific or intended for particular applications. Customers should carefully verify compatibility before purchasing.

2. Product numbers, OEM references, vehicle details, and technical specifications can assist in identifying the correct replacement part.

3. If there is any uncertainty regarding compatibility, we recommend contacting our customer service team before ordering.

4. Products should be installed according to applicable technical instructions and safety requirements, preferably by a qualified professional.

5. Auto Elektra Veghel is not responsible for damage demonstrably resulting from improper installation or incorrect use, to the extent permitted by law.

6. These provisions do not restrict statutory rights relating to inaccurate product information or non-conforming goods.

Article 11 – Business Customers

1. Business customers are companies and professional buyers purchasing products for business purposes.

2. Separate pricing, payment, delivery, and return arrangements may apply to business orders.

3. Business customers are responsible for providing accurate company information and billing details.

4. Any specific B2B arrangements agreed upon in writing shall take precedence where applicable.

5. Consumer protection provisions that apply exclusively to private purchases do not automatically apply to business transactions.

Article 12 – Retention of Title

1. To the extent permitted by law, delivered products remain the property of Auto Elektra Veghel until the applicable payment obligations have been fulfilled in full.

2. Customers must handle products subject to a valid retention-of-title arrangement with reasonable care.

3. Retention of title shall be exercised in accordance with applicable legislation.

Article 13 – Liability

1. Auto Elektra Veghel shall be liable for damages where required by applicable law or the relevant agreement.

2. We shall not be liable for damage caused exclusively by improper use, unprofessional installation, or unauthorised modifications, to the extent permitted by law.

3. We are not responsible for delays or failures arising from circumstances for which we are not legally accountable.

4. Any limitations of liability apply only to the extent permitted by applicable law.

5. Nothing in these conditions excludes or limits liability that cannot legally be excluded.

Article 14 – Force Majeure

1. Force majeure refers to circumstances beyond our reasonable control that temporarily or permanently prevent us from fulfilling contractual obligations.

2. Such circumstances may include major transportation disruptions, natural disasters, and government restrictions.

3. Where possible, we will inform affected customers about the impact on their orders.

4. The rights and obligations of both parties in cases of force majeure are governed by applicable law.

Article 15 – Complaints and Customer Service

2. Please describe your complaint clearly and include your order number where available.

3. We handle complaints carefully and aim to provide a substantive response as quickly as possible.

3. If a dispute cannot be resolved through mutual agreement, it may be submitted to the court having jurisdiction under applicable law.
